            Delegate Bates moves to amend the Com Sub for H.B.2002 on page 21, section 2, line 73, following the period, by inserting the following:

            “(23) “Substandard service” means downward and upload deviations of the speed are less than 75% of the speed of which a customer has subscribed.” and by renumbering the subsequent subdivision (23) accordingly;

            And,

            On page 24, Section 21, line 1, by inserting an (a) before the words “A cable television”;

            And,

            On page 24, Section 21, line 5, following the period, by inserting the following:

            “(b) A cable television or broadband system operator shall provide upon request by a subscriber, a credit or refund from the cable or broadband operator in the amount that reflects of the proportionate share of substandard service occurring during a billing period unless the cause of the substandard service is caused by circumstances beyond the control of the provider.

            (c) A subscriber may prove substandard service by submitting evidence of samples of downstream and upstream by utilizing an internet speed test website commonly accepted by the broadband industry by submitting records of 5 speed test samplings taken on separate days during a consecutive 10-day period.”
